Merchant Agreement

1. Overview
This Merchant Agreement (“Agreement”) is between you (“Merchant,” “you,” or “your”) and InFlux LLC, the company that operates LeaveTheGear (“LTG,” “we,” “us,” or “our”).
By creating a store on LeaveTheGear, you agree to the terms of this Agreement as well as our Terms of Service. If you do not agree, do not create a store on the platform.
2. Gear Safety & Condition Standards
As a merchant on LeaveTheGear, you are solely responsible for the safety and condition of all gear you list for rental. You agree to:
- Inspect all gear before each rental and ensure it is in safe, working condition
- Immediately remove any damaged, defective, or recalled items from your listings
- Follow all manufacturer guidelines for maintenance, use, and replacement schedules
- Comply with all applicable local, state, and federal safety regulations for the gear you rent
3. Liability
You are solely responsible for any injury, illness, death, property damage, or other harm arising from gear you rent through LeaveTheGear. LTG does not inspect, certify, or warranty any gear listed on the platform.
You agree to indemnify and hold harmless InFlux LLC, its officers, employees, and agents from any and all claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your gear, your rental operations, or your breach of this Agreement.
4. Insurance
We strongly recommend that all merchants maintain appropriate commercial liability insurance covering their rental operations and the gear they list on LeaveTheGear.
While insurance is not currently required to list on the platform, we reserve the right to require proof of insurance as a condition of continued use at any time, with reasonable notice.
5. Listing Accuracy
You are responsible for ensuring that all information in your store and item listings is accurate and up to date, including:
- Item descriptions, including size, condition, and any limitations
- Photos that accurately represent the gear available for rental
- Pricing that reflects what the renter will pay at pickup
- Availability and scheduling information
- Store hours and location details
- Contact information
Listings that are misleading, inaccurate, or deceptive may result in suspension or removal of your store from the platform.
6. Dispute Resolution
Disputes between you and a renter — including disagreements about gear condition, rental terms, or payment — are between you and the renter. LTG is not a party to these disputes and is not obligated to mediate or resolve them.
However, patterns of renter complaints, unresolved disputes, or negative feedback may result in a review of your account, and in some cases, suspension from the platform.
7. Cancellations
Cancellation of bookings is governed by the refund policy described in our Terms of Service. The key points for merchants:
- If you cancel a renter's booking, the renter will receive a full refund of the $2.00 booking fee.
- Frequent or last-minute cancellations by your store may affect your standing on the platform, including reduced visibility or suspension.
8. Payment Terms
LTG only collects the $2.00 booking fee from renters. You are responsible for collecting the rental payment directly from the renter at the time of pickup, using your own point-of-sale system or payment method.
Platform Fees
Monthly platform fees are based on confirmed rentals (bookings where the renter paid the $2.00 fee) across all of your store's locations in a calendar month:

Location Fees
Every store includes 2 locations free. Each additional location beyond the first 2 is $10/month, billed alongside your platform fee.
Storefront Website
The optional Storefront website add-on is $30/month with a 30-day free trial that starts when your store is approved. See our pricing page for the current schedule.
We will provide at least 30 days' notice before any pricing changes take effect. You may close your account at any time if you do not agree to updated pricing.
9. Account Termination
You may close your store and delete your account at any time through your account settings or by contacting us at legal@influx-llc.com.
LTG reserves the right to suspend or terminate your account at any time for reasons including, but not limited to:
- Violation of this Agreement or our Terms of Service
- Fraudulent or deceptive practices
- Repeated safety complaints from renters
- Failure to honor confirmed bookings
- Abuse of the platform or its users
10. Governing Law
This Agreement is governed by the laws of the United States and the State of [STATE]. Any disputes not resolved informally shall be subject to the exclusive jurisdiction of the courts in the State of [STATE].
