1. What LeaveTheGear Is (and Isn't)

LeaveTheGear (“LTG,” “we,” “us,” or “our”) is an online marketplace that helps you find and reserve outdoor gear from independent rental shops. We are operated by InFlux LLC.

LTG is not a rental company. We do not own, store, or rent any gear. We do not set rental prices, collect rental payments, or manage rental agreements. The shop you book with is solely responsible for the gear, the rental terms, and your experience on the ground.

By using LeaveTheGear, you agree to these Terms of Service. If you do not agree, please do not use the platform.

2. Eligibility

You must be at least 18 years old to create an account or make a booking on LeaveTheGear. Outdoor rental equipment can be dangerous, and by using LTG you confirm that you meet this age requirement and are legally capable of entering into a binding agreement.

If you are creating an account on behalf of a business, you confirm that you have the authority to bind that business to these terms.

3. Account Responsibilities

You are responsible for keeping your account credentials secure. Do not share your password. If you suspect unauthorized access to your account, contact us immediately at legal@influx-llc.com.

You agree to provide accurate information when creating your account and to keep it up to date. We may suspend or terminate accounts that contain false or misleading information.

4. Bookings & the $2 Booking Fee

When you reserve gear through LeaveTheGear, you pay a $2.00 non-refundable booking fee to LTG. This fee covers platform costs and confirms your reservation with the shop. The rental payment itself is collected separately by the shop at the time of pickup.

Refund requests must be submitted through your account or by emailing legal@influx-llc.com. LTG is not responsible for and does not process refunds on rental amounts paid to the shop.

5. LTG's Role as a Marketplace

LeaveTheGear provides a scheduling and discovery platform. We do not participate in the rental transaction beyond accepting the $2 booking fee. When you show up at the shop, your relationship is directly with that rental shop — not with LTG.

LTG does not guarantee the availability, condition, safety, or suitability of any gear listed on the platform. Shop listings are created and maintained by the shops themselves, and LTG does not independently verify gear descriptions, pricing, or availability.

6. Limitation of Liability

To the fullest extent permitted by law, InFlux LLC and LeaveTheGear are not liable for:

• Any injury, illness, death, or property damage related to gear you rent through the platform
• Any loss arising from a shop's failure to honor a booking
• Gear that is defective, unsafe, or not as described
• Disputes between renters and rental shops
• Indirect, incidental, or consequential damages of any kind

Our total liability to you for any claim arising from use of LeaveTheGear shall not exceed the amount you paid to LTG (i.e., the $2.00 booking fee for that transaction).

7. Indemnification

You agree to indemnify and hold harmless InFlux LLC, its officers, employees, and agents from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your use of LeaveTheGear, your violation of these terms, or your interactions with any rental shop.

8. Content & Reviews

You own the content you submit to LeaveTheGear (reviews, photos, etc.). By submitting content, you grant InFlux LLC a non-exclusive, worldwide, royalty-free license to display and distribute that content as part of the LeaveTheGear platform.

You agree not to post content that is false, defamatory, abusive, harassing, or illegal. LTG reserves the right to remove any content that violates these standards or that we determine, at our sole discretion, is harmful to the platform or its users.

The LeaveTheGear platform, including its design, code, and trademarks, is owned by InFlux LLC. You may not copy, modify, or reverse-engineer any part of the platform.

9. Dispute Resolution

Disputes about your rental experience — gear condition, shop behavior, refunds on rental amounts — are between you and the rental shop. LTG is not a party to those disputes and has no obligation to mediate or resolve them.

Disputes specifically about the $2.00 booking fee or your LTG account should be directed to legal@influx-llc.com.

Any legal disputes with InFlux LLC shall be governed by the laws of the State of [STATE], without regard to conflict of law principles.

10. Account Termination

You may delete your account at any time by contacting us at legal@influx-llc.com.

LTG reserves the right to suspend or terminate your account at any time for any reason, including but not limited to: violation of these terms, fraudulent activity, or abusive behavior toward shops or other users. Where possible, we will give you notice before taking action.

11. Privacy

Our Privacy Policy explains what data we collect, how we use it, and how you can request deletion. By using LeaveTheGear, you agree to our data practices as described there.

12. Changes to These Terms

We may update these Terms of Service from time to time. When we do, we will update the “Last updated” date at the top of this page. Continued use of LeaveTheGear after changes take effect constitutes your acceptance of the revised terms. For significant changes, we will try to notify you by email.

13. Governing Law

These Terms are governed by the laws of the United States and the State of [STATE]. Any disputes not resolved informally shall be subject to the exclusive jurisdiction of the courts in the State of [STATE].
